Vorrei ringraziare innanzitutto per la presentazione dei lavori di monitoraggio sul rispetto della Carta dei diritti fondamentali e chiedere se siano giudicate e monitorate con la stessa attenzione, e in che modo e con quali criteri, le stesse Istituzioni Europee, quando infrangono la Carta. E vorrei chiedere come il Parlamento possa giudicare, in questo quadro, i comportamenti del Consiglio e della Commissione. È una domanda che dovremmo porre a noi stessi in due campi.
Il primo è quello della politica delle migrazioni, e in particolare dell’Agenda sulla migrazione di cui si sta discutendo proprio in questi giorni al Consiglio Europeo. Il fatto è che siamo alle prese con grossi rischi di violazione della Carta, soprattutto per quanto riguarda il principio del non-respingimento e l’assenza di proposte comunitarie intese a creare vie legali d’accesso in Europa, e di fuga da paesi in guerra o da dittature. È un tema contemplato nelle relazioni presentate in questa Commissione, ma non capisco se ci si riferisca solo alla violazione dei diritti da parte degli Stati Membri, o anche da parte delle Istituzioni europee.
Il secondo campo – e qui mi aggancio a quanto detto dal collega Kostas Chrysogonos – è quello della politica dell’austerità e degli effetti che essa ha sui diritti fondamentali e sui diritti sociali. È chiaro che anche in questo caso siamo di fronte al non rispetto della Carta. L’austerità è in sé una violazione sistematica dei Trattati, e sta creando un divario pericolosissimo fra le politiche comunitarie e i verdetti popolari che vengono emessi nelle elezioni. E’ un problema con cui dobbiamo cominciare a fare i conti. Perché dico questo? Perché molte violazioni di cui giustamente parlate nel Rapporto – l’estendersi di episodi di hate crimes, xenofobia, rifiuto del diverso, islamofobia – sono una conseguenza di politiche europee che, sul piano comunitario, violano la Carta dei diritti e producono, come contro-reazione, forti ondate xenofobiche nei paesi membri.
Intervento di Kostas Chrysogonos (Syriza – GUE/NGL):
Both reports that we are discussing today, concerning the application of the Charter of Fundamental Rights of the European Union during 2014, seem to be out of time and out of place. They are not addressing the most important issue of violation of fundamental rights within the Union, which is the massive violation of social rights through the murderous austerity policies implemented by the European institutions. Social and economic rights are not mentioned, either in the Report of the Fundamental Rights Agency or in the Commission’s Report (SWD 2015/99 final). Chapter 4 of the Charter of Fundamental Rights entitled “Solidarity” foresees, among others, a right of collective bargaining at Art. 28, a right of protection in the event of unjustified dismissal at Art. 30, a right to social security and assistance at Art. 34 and a right to health care at Art. 35. All these rights are being violated through policies imposed by the European institutions upon member states of the Union e.g. in Greece the Commission and the ECB, as members of the Troika, have nullified collective bargaining, have cut pensions and salaries to levels below the minimum of existence, have undermined health care in such a way that mortality has risen about 15% and so on. It is noteworthy mentioning that many of the measures implemented after Troika demands have been found to be in breach of international law of human rights, in particular in breach of the European Social Charter through decisions of the European Committee on Social Rights and in breach of several ILO Conventions through decisions of the ILO. Those violations entail analogous breaches of the aforementioned Articles of the Charter of Fundamental Rights of the EU.
Nevertheless the European institutions concerned not only show no willingness to comply with these findings, but they demand from the new Greek government, within the frame of the ongoing negotiations about the Greek financial adjustment programme, further violations of social rights of hundreds of thousands of persons who live right now at the edge of starvation. It almost looks as if we are living under a state of emergency, where fundamental social rights are suspended or sacrificed at the altar of austerity. Respect for human rights must be shown to all of them, if the pledge is genuine. Selective respect for some of them going together with disregard for others is tantamount to hypocrisy.
